These terms describe the rules for using PhotoQuill: accounts, credits and subscriptions, content ownership, the AI models we use, and our Acceptable Use Policy for AI-generated content — including how to report content.

1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of PhotoQuill at photoquill.com (the "Service"). "PhotoQuill", "we", "us" and "our" mean the operator of the Service. By creating an account, buying a plan or otherwise using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Section 7 is our Acceptable Use Policy for AI-generated content. It is part of these Terms and applies to every account.
2. The Service
PhotoQuill is an online photo editor. Its standard editing tools run in your browser; its AI features generate images from text prompts, edit a photo according to your instructions, erase objects you mark and remove backgrounds.
Everything the AI features produce is generated by AI models. Results can be inaccurate, unexpected or imperfect, and similar results may be produced for other users. The AI models we use are listed by name in Section 6.
PhotoQuill's standard (non-AI) editing tools run locally in your browser. A photo is sent to our servers only when you use an AI feature on it.
3. Accounts and Eligibility
You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) to use the Service, and at least 18 years old — or the age of majority where you live — to buy a paid plan. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian.
You must give accurate information when you sign up, keep your login secure and are responsible for all activity under your account. Do not create multiple accounts to collect extra free credits or to get around a suspension.
4. Credits, Plans and Payments
- AI features use credits. Free accounts receive a daily credit allowance; paid plans add a monthly allowance, and one-time credit packs may also be offered. Current prices, credit amounts and plan details are shown on the pricing page.
- Free credits expire at the end of each day. Subscription credits are granted according to your plan and do not roll over when the next allowance is granted. Credits from one-time packs do not expire while your account is open. Credits have no cash value and cannot be transferred.
- Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your dashboard; the cancellation takes effect at the end of the current billing period and you keep your plan benefits until then.
- If a generation fails, or its output is withheld by our safety checks, the credits are returned to your balance automatically.
- Orders are processed by our payment partners Creem or Waffo. The partner that processes your order is the Merchant of Record: it sells the plan to you, collects the payment, handles applicable sales tax or VAT and issues your receipt, and its name appears at checkout and on your receipt. We never see or store your full card details.
- Prices are in US dollars. Taxes may be added at checkout depending on where you live.
- Refund eligibility and timing are described in our Refund Policy.
5. Your Content and AI Outputs
Your inputs. You keep any rights you have in the prompts, photos and other material you submit ("Inputs"). You confirm that you have all the rights and permissions needed to submit them — including the consent of every identifiable person in a photo you upload.
What we may do with them. You give us a limited licence to host, process and transmit your Inputs and the images generated for you ("Outputs"), and to send them to the AI providers listed in Section 6, only as needed to run the Service, keep it safe (including the moderation described in Section 7) and comply with the law. We do not train AI models on your Inputs or Outputs and we do not sell them.
Your outputs. As between you and us, you own the Outputs generated for you and may use them for personal and commercial purposes, subject to these Terms, the law and the rights of others. Because Outputs are made by AI, they may not be protected by copyright in some countries, may resemble existing works or outputs generated for other users, and are not guaranteed to be unique. You are responsible for making sure your use of an Output is lawful — especially commercial use involving recognisable people, brands or existing works.
Our property. The PhotoQuill name, logo, website and software belong to us. These Terms do not give you any right to use them except to use the Service.
6. AI Models We Use
PhotoQuill does not develop its own AI models. Its AI features run on the following third-party models, which are named in the app where you choose them:

PhotoQuill is an independent product. It is not affiliated with, sponsored by or endorsed by the developers above; their model names are used only to tell you which technology produces your results. Every model is covered by the same content moderation (Section 7.6) — switching models does not bypass it.
AI-generated output. Outputs are AI-generated. When you publish or share them, do not present them as human-made or as real photographs where that could mislead people, and follow any AI-disclosure rules that apply to you (for example on social platforms or in advertising). Some models embed invisible provenance marks or metadata in their images (for example Google SynthID or C2PA metadata); do not remove or tamper with them.
7. Acceptable Use Policy — AI-Generated Content
PhotoQuill is committed to safe, lawful and responsible use of AI. This policy sets out what you may not create with PhotoQuill, how we moderate content, how to report a problem and what happens when the rules are broken. It applies to every account and every model, on free and paid plans alike.
7.1 Scope
This policy applies to everything you submit to or create with the AI features:
- Prompts — text prompts, negative prompts and editing instructions.
- Uploads — photos you open or upload when you use an AI feature (for AI editing, object removal or background removal).
- Images — AI-generated and AI-edited images.
7.2 Prohibited content — the six categories
You may not use PhotoQuill to generate, edit, upload or distribute content in any of these six categories:
- Pornography / NSFW content. Nudity, sexual acts, sexually suggestive or fetish imagery and any other adult content — including "implied", "artistic" or partial nudity. PhotoQuill does not offer adult content on any plan.
- Violence / gore. Graphic violence, gore, mutilation, torture or cruelty to people or animals; content that glorifies or encourages violence, self-harm or suicide; content that promotes terrorism or violent extremism.
- Hate speech. Content that attacks, demeans, dehumanises or incites hatred or discrimination against people because of race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age or serious illness — including hate symbols and slurs.
- Child-unsafe content (CSAM). Any sexual or sexualised depiction of minors, and any content that sexualises, grooms or endangers children — whether it looks real, drawn, AI-generated or "fictional". Zero tolerance applies (7.3).
- Deepfakes / impersonation. Realistic images of a real, identifiable person — a public figure or a private individual — in a false, sexual, humiliating or misleading situation, or that could be passed off as a real photo of them; editing someone's photo without their permission; impersonating any real person, brand or organisation.
- Copyright / trademark infringement. Copyrighted characters, artworks, photographs or other protected works, and brand names or logos, reproduced without permission from the rights holder.
7.3 Absolutely prohibited — zero tolerance
The following leads to an immediate permanent ban and, where the law requires or allows it, a report to the authorities (for child sexual abuse material, to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement):
- Child sexual abuse material (CSAM) or any sexual content involving minors.
- Content that promotes or facilitates terrorism, violent extremism or mass violence.
- Technical instructions for weapons of mass destruction.
- Content inciting genocide or ethnic hatred.
- Non-consensual sexual or intimate content depicting real individuals, including sexual deepfakes.
7.4 Restricted content — subject to review
Adult content is not permitted on PhotoQuill at all (see 7.2). The following is allowed only with care, and we may remove it after review:
- Violent themes: only in a clear creative context (for example a stylised fantasy scene), never graphic or glorifying.
- Political content: content about real politicians, elections or current events must not be misleading. Realistic depictions of real people are covered by the deepfake rule in 7.2.
- Medical, legal or financial claims: must not be misleading and must comply with local rules.
7.5 Prohibited conduct
- Creating or spreading misinformation or claims known to be false.
- Impersonating real people, brands or organisations.
- Infringing intellectual-property, publicity or privacy rights.
- Passing off AI-generated content as human-made or as a real photograph in order to deceive.
- Bulk-generating spam or deceptive commercial content.
- "Jailbreak" prompts or other attempts to get around our safety measures — for example misspellings, coded words, other languages, or splitting a request into harmless-looking parts.
- Uploading photos of other people without their consent, or photos of minors in any context that could put them at risk.
- Automated or scripted access, reselling access, or creating accounts to evade limits or enforcement.
- Any other illegal activity.
7.6 How we moderate content
We run several layers of moderation. They apply to every account and every model.
Before generation (automated, real time). Every prompt — including negative prompts and editing instructions — is checked by two independent moderation services, the Creem Moderation API and Waffo Prompt Sift, before any model runs. If a check rejects the prompt or cannot be completed, the request is refused and no credits are charged.
After generation, before you see it (automated).
- Runware content-safety check — every image from FLUX.2 [klein], FLUX.2 [dev], FLUX.2 [max], Z-Image Turbo, Seedream 4.5, Nano Banana 2 (fast), Nano Banana Pro (fast) is checked by Runware's safety classifier before it is shown to you. A flagged image is discarded and never delivered, the event is logged, and the credits are refunded.
- Google safety filters — Nano Banana 2, Nano Banana Pro, Nano Banana 2 Edit run with Google's built-in safety filters, which refuse to produce prohibited images.
- fal.ai safety checker — FLUX.2 [pro] Edit, Seedream 4.5 Edit run with the provider's safety checker switched on.
- Removal tools — Finegrain Eraser, Bria RMBG background removal, BiRefNet background removal only remove parts of your photo; they do not create new subject matter.
- Usage monitoring — rate limits and monitoring of unusual usage patterns.
- Human review — blocked and flagged items are recorded in our moderation log. A member of our team reviews every user report and the flagged items that need a human decision (for example repeated flags on one account, or an appeal), and records the decision.
- Regular audits — at least once a month we review the moderation log and a sample of generations, and act on what we find — for example by reviewing accounts with repeated flags.
- Moderation records — we keep the verdict of each check, and the text of any prompt that was blocked or flagged, for 180 days (see our Privacy Policy).
- No public feed — generations are private to your account; PhotoQuill does not publish user creations in a public gallery.
7.7 Severity levels

7.8 Reporting content
Anyone — users, rights holders or people depicted — can report content made with PhotoQuill that breaks this policy, including AI impersonation of you or misuse of your work.
- How to report: email support@photoquill.com with the subject line "Content Report". For child safety or an imminent threat to someone's safety, use the subject "URGENT Content Report"; these are handled first.
- What to include: a link, screenshot or description of the content, where you found it, which rule it breaks, and how we can contact you.
- Confidentiality: we do not reveal a reporter's identity to the reported user.
- Impartiality: every report is reviewed on its merits.
- Abuse of reporting: knowingly false or malicious reports are recorded and may themselves lead to action.
This mailbox is monitored by our team. If a child is in immediate danger, contact your local police first. Child sexual abuse material can also be reported directly to the NCMEC CyberTipline (report.cybertip.org) or the Internet Watch Foundation (report.iwf.org.uk).
7.9 Response and processing times

The initial response is our acknowledgement that the review has started. Every report goes through the same steps: received → triaged (L1–L4) → reviewed → decision → enforcement → the reporter is told the outcome. If a case needs more time, we tell the reporter why.
7.10 Enforcement actions
A prompt that fails our automated checks is simply refused and not charged. When we confirm a violation, we take one or more of these actions, depending on its severity and the account's history:

7.11 Appeals
If you believe we made a mistake — a blocked prompt, removed content or an action on your account — email support@photoquill.com with the subject line "Appeal" within 30 days of our notice. Tell us what happened and why you think the decision is wrong. We review appeals within 10 business days: the case is re-examined from the start, taking into account any new information you give us, and we tell you the outcome. If the original decision was wrong, we reverse it — restoring access and returning any credits taken.
7.12 Changes to this policy
We update this policy as laws, models and risks change. Material changes are announced at least 15 days in advance by email or on the website, unless an immediate change is needed for safety or legal reasons. Continued use of the Service after a change means you accept it.
8. Copyright and Trademark Complaints
If you believe content made with PhotoQuill infringes your copyright or trademark, email support@photoquill.com with the subject line "Copyright Notice" and include: your name and contact details; the work or mark you own; the content you believe infringes it and where it is; a statement that you believe in good faith the use is not authorised; and a statement that the information in your notice is accurate and that you are the rights holder or authorised to act for them, with your physical or electronic signature.
We handle these notices as L3 reports (Section 7.9), remove infringing content and close the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address.
9. Third-Party Services
The Service relies on third-party providers — AI model providers, payment partners, hosting and sign-in providers — listed in our Privacy Policy. Their services are governed by their own terms, and we are not responsible for them.
10. Service Availability and Changes
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may add, change or remove features, models, plans and limits over time. If we remove a model, the credits you hold remain usable with the other models.
11. Suspension, Termination and Account Deletion
You can stop using the Service at any time and delete your account from your dashboard. Deleting your account cancels your subscription so that it does not renew, and forfeits any remaining credits.
We may suspend or close an account as described in Section 7, and also for fraud, payment chargebacks, abuse of the Service or where the law requires it. Where appropriate we tell you the reason and how to appeal.
12. Disclaimers
The Service and all Outputs are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including that the Service will meet your needs, that Outputs will be accurate, unique or fit for a particular purpose, or that they will not infringe the rights of others.
13. Limitation of Liability
To the fullest extent permitted by law, PhotoQuill is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
14. Indemnity
You agree to indemnify us against claims, losses and costs arising from your Inputs, your use of Outputs or your breach of these Terms.
15. Changes to These Terms
We may update these Terms from time to time. Material changes are announced at least 15 days in advance by email or on the website. Continued use of the Service after a change takes effect means you accept the updated Terms.
